PRIZE DETAILS AND OFFICIAL RULES FOR POWER BALLAD CONTEST: No purchase necessary to enter or win. Purchasing does not improve chances of winning.
OFFICIAL SPONSOR: Algonquin Books of Chapel Hill, P.O. Box 2225, Chapel Hill, NC 27515-2225 ("Sponsor").
1. HOW TO ENTER: Individuals can enter the “Rock On Power Ballad Lyrics Contest” ("the Contest"), by emailing their office inspired power ballad lyrics (lyrics not to exceed 500 words), name, address, and phone number to: powerballad@algonquin.com between 12:00 a.m. ET on February 7, 2008 and 11:59 p.m. ET on March 7, 2008. No purchase, entry fee, or payment is necessary to enter the Contest. Limit one (1) entry per person. For purposes of these rules, "receipt" of an electronic entry occurs when Sponsors' servers record the entry information upon clicking the "submit" (or similar) button. In the event of a dispute as to the identity of the entrant, the entrant will be deemed to be the individual who is the registered holder of the e-mail account. More than 1 entry by the same individual, whether using one or more e-mail accounts, will not be accepted and may result in disqualification of all entries. Automated entries are prohibited, and any use of such automated devices will result in disqualification. Sponsors are not responsible for incorrect or inaccurate entry of information by entrants; lost entries or transmissions; interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions of the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to entrants' systems. Incomplete entries will be voided. All entries become the property of Sponsors and will not be returned.
2. ELIGIBILITY: The Contest is open to U.S. residents 21 years of age or older, who are in the continental United States and void outside the U.S., in Puerto Rico, and where prohibited. The contest is void where prohibited and is subject to all applicable federal, state, and local laws and regulations.
3. SELECTION OF WINNERS: Dan Kennedy will select one winner each week between February 7 and March 7, 2008. Winners will be notified by phone, mail, or e-mail by March 7, 2008. If winning individuals cannot be reached or do not acknowledge notification within five (5) days of the first notification attempt, the prize will be forfeited and alternative weekly winner will be selected from the remaining eligible entries.
4. PRIZES: Winners will receive a Rock On t-shirt and a signed copy of Rock On: An Office Power Ballad by Dan Kennedy.
5. PRIZE RESTRICTIONS: Prize is non-refundable for cash, non-endorsable, non-transferable, and non-changeable once issued. No refunds or credit changes are allowed. If lost, will not be replaced. Winners are responsible for any tax consequences and compliance with all governmental reporting and payment requirements. Prizes are not transferable and may not be substituted or redeemed for cash by winners. Sponsors reserve the right to substitute prize for one of equal or greater value (approximate retail value: $30.00).
6. DISCLAIMER/PUBLICATION: Winning individuals assume all liabilities for any damages caused or claimed to be caused by participating in the contest and/or the acceptance, awarding, receipt, use, and/or misuse of the prizes, and winners release Sponsors, its parent companies, subsidiaries, and affiliated companies, their respective officers, directors, and employees, Sponsors' marketing and promotional agencies from any such liability with respect to, or arising out of, this Contest. Entering the Contest constitutes permission to Sponsors and their advertising and promotional agencies to use the winning lyrics, individual’s name, photos, and likeness for advertising and publicity without further compensation, unless prohibited by law.
7. ADDITIONAL RULES: Sponsor is not responsible for: (a) telecommunication, network, electronic, technical, or computer failures of any kind, for inaccurate transcription of entering information, for any human error, or for entries that are stolen, misdirected, garbled, delayed by computer transmissions, incomplete, illegible, corrupted, lost, late, or damaged, and all such entries are void; and (b) inability to access the article on-line, or any other error or malfunction which may occur, including any injury or damage to any persons, computer-related or resulting from participating in the Contest. By participating in the Contest participants agree to these official rules and the decisions of Sponsor. Failure to comply to any of these rules may result in disqualification from the Contest. Sponsor reserves the right to disqualify from the Contest any person they believe has intentionally violated these rules. In the event the Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, that is beyond the control of Sponsor, Sponsor reserves the right to withdraw the transmission of the Contest and to select a winner from among all entries received up to the date of withdrawal.
8. NAME OF WINNER/SPONSORS: Winners’ names can be obtained by sending a self-addressed stamped envelope to: Algonquin Books of Chapel Hill, P.O. Box 2225, Chapel Hill, NC 27515-2225. All requests must be received by March 28, 2008.
